Newland placed large signs on the tract confirming that it was "mixed commercial/retail" which is also consistent with the community land maps they have distributed over the past few years. We relied on those representations when purchasing our home and moved to the area to get away from Apartment developments. We invested heavily in the lake lot and our home which is directly across from the C-5 tract. The development of a multi-family apartment complext would greatly diminish the value of our home, create congestion around the lake and community ammenities, and create safety and traffic concerns. For these reasons, among others, I am strongly opposed to this prospective development.

I was given examples such as restaurants, shops and other forms of light retail. I specifically asked about the potential of low income or high density housing and I was assured this would not happen. It certainly appears deceitful that Newland (and others) entice in homeowners on a certain basis, then just as the homes are sold and families take up residence they change the plans. There are three major issues which I object to;
1. Buying a property under false pretences
2. The considerable additional volume of people/traffic. This also raises significant safety concerns for our children due to the heavy traffic.
3. A significant apartment block will be unsightly

This is absolutely outrageous! It is bad enough there is an apartment complex under construction at 1093 and Katy-Gaston, but there are a few others along 1093 that are also being proposed. Its absurd to think of the value that homeowners are going to lose if this transpires. I, like many others in opposition would have not purchased anywhere near this area had the notion of anything resembling a mulit-dwelling unit been brought to my attention. "upscale retail" "mixed used commericial/retail" - is this now some sort of weird joke? I sincerely hope the builders of Cinco Ranch, especially Highland and JKyle Homes are getting involved and taking this seriously. With a new section just opening in Park Place, this could have devastating impact on their progress.
As many of the nearby residents of Spring Lake would agree, this is such a serene and peaceful area and to ruin the community atmosphere of this location with an apartment complex, would be a down right shame. This tract is SCREAMING for upscale eateries, high end retail, boutique style shops, etc. The lake is too beautiful and creates such value for those nearby that to destroy it with apartments is borderline criminal.

We were informed the property in questions was designated for light commercial retail space. On all the maps and signage I have seen, this area was not designated for multi-family dwellings. I am highly disappointed with Newland for presenting the areas to potential homeowners as upscale retail, but now that the area is almost built-out, they have changed their mind about what "commercial use and retail" means. Apartments by the lake is NOT what they promised us. One other comment - Multi-family dwellings within Cinco Ranch I do not seem to have to comply with the same HOA regulations that the homeowners do. They are in desperate need of regular maintenance and repairs. This should NOT be just about Newland making money. This is about an upscale single-family dwelling community being ruined. I agree with others - Newland, Simply Cinco and the builders consistently represented this tract as "light traffic, high end mixed retail". Newland placed large signs on the tract confirming that it was "mixed commercial/retail" which is also consistent with the community land maps they have distributed over the past few years. We relied on those representations when purchasing our home and moved to the area to get away from Apartment developments. We invested heavily in the lake lot and our home which is directly across from the C-5 tract. The development of a multi-family apartment complext would greatly diminish the value of our home, create congestion around the lake and community ammenities, and create safety and traffic concerns. For these reasons, among others, I am strongly opposed to this prospective development.

It is very disappointing to hear of the intended development of Tract C5. Whilst I am sure the apartments will be "upscale" and be a valuable property resource for professionals (teachers/nurses/single parents) it will add excessively to the burden on already limited resources. Even worse than an apartment block however, is the construction of a McDonalds restaurant in the vicinity. This, above anything else, lowers the tone of the area and whilst apartments may reduce the amount of sidewalk we have to walk, on a McDonalds will bring in much more through traffic, teens/hangers out, and nasy cooking fumes.
When we bought in CincoSW it was because of the amount of green space, property design and overall aesthetics. When the area first opened Newland seemed to have everything "right", now it seems that they have lost the plot and you wonder what the future holds. Potentially there are bigger issues here though, as we are already lacking recreational areas (swmimming pools & parks)as Newland has no money to build them. I am sure this issue is going to be one of many and the worst is yet to come. As for a drain on KatyISD, the situation is already dire and it is going to get much worse before it gets better. STOP the building of down-market chain stores and apartments and build what you promised - upscale restaurants, recreational green space and good family homes.

Even though I'm not a Cinco Ranch resident, I live in the adjoining Pine Mill Ranch, and this project will negatively impact the surrounding area. We had our annual meeting tonight, and all the residents at my subdivision are totally opposed to it as well. It doesnt make sense to have an apt complex at such an appealing intersection. The roads are just not equipped to handle such a high density project unlike the project on 1093 and Gaston or the other project on 99 and Kingsland; both are near major highways that can siphon the traffic away quickly. We had closed on our house two weeks ago to find out that there will be an apartment complex, built right in front of us. If I had known this, I would have broke the contract or asked to decrease selling price at least 20%. But Obviously people who are selling these properties have mal intent. We were told when we purchased our home there would be no apartments in that area. We specifically asked about that and were assured it was going to be upscale retail. We moved out of our previous neighborhood because apartments started popping up right next to us. When we were evaluating the option of building a home in Cinco SW, we asked our real estate agent, the builder (actually several of the builders we were considering) and the Simply Cinco office at La Centerra what was planned for the sites at the 4 corners of Spring Green and Cinco Ranch Blvd. All of them said retail stores, businesses and resturants. When we specifically asked them about potential for industrial use, well pads/facilities or apartments; they said there were no plans for them. Cinco Ranch: a Master Planned Community that used to have a plan. Newland should be trying to enhance the community, not de-value it. This is a clear case of misrepresentation. We moved from the older part of Cinco Ranch to Cinco SW because of the track record of the development. There are no apartments in the heart of old Cinco, why would they be built in the middle of a residental area in Cinco SW? We spoke with multiple builders about the development of the lake area. Not one mentioned the possibility of multi-family housing in the area, much less on the lake. This isn't a logical place for an apartment complex. This is a laydown fraudalent inducement case and if Newland has any competent senior managers, they will stop the apartment idea immediately. The court system will laugh at Newland if they attempt to stretch the definition of "commercial development" to include multi-family residential. That is laughable. If you take 20% times all the property values in Cinco SW, that is a much bigger check for Newland to write than the .5 million they would receive from the sale of the property. It will save all parties time and money if Newland can perform simple arithmetic.

The interesting thing is that when we bought our house, we knew that the area at 1093/Cinco Terrace would be apartments because Newland's Land Plan that was in our builders office had that area designated as such. They also had another area on 1463 near Cinco Ranch Blvd designated the same. NOWHERE does it show that apartments would be built near Spring Lake, but to the contrary - it would be mixed-use retail/commercial. Of course, what type of mixed-use was going to be hard to determine even though high-end light traffic had been mentioned. There is no way that we would have chosen to purchase in this area only to see our property values plummet due to fraudulent misrepresentation by the developer of this fine community. The value of the Spring Lake area is too overwhelming of a draw to create a negative impact on it with the construction of an apartment complex.
There has to be some sort of recourse or way to prevent this from happening for the residents of the area. Please don't let this happen!
